ACKNOWLEDGEMENT OF PARTICIPANT RESPONSIBILITY, EXPRESS ASSUMPTION OF RISK AND RELEASE OF LIABILITY

IN CONSIDERATION of being permitted to participate in any way in the activities of Nerf under the auspices of the University of Maryland Nerf Activity Society (“NAS”), I hereby acknowledge, appreciate, and agree that:

1. There is a risk of serious injury from the activity and weaponry involved in the activities of the NAS, including but not limited to the potential for permanent disability, and while particular protective equipment and personal discipline will minimize this risk, the risk of serious injury does exist;
2. There is also a risk of property damage, including but not limited to my clothing, items on my person or in (or on) my clothing, and my personal activity related materials;

3. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVIN IF ARISING FROM THE NEGLIGENCE of those persons released from liability below, and assume full responsibility for my participation;

4. I understand that the activities of Nerf are physically and mentally intense. I understand the rules of play and will comply with all rules and regulations. If I observe any unusual or unnecessary hazard during my participation, I will notify the nearest moderator of such hazard as soon as reasonably practical; and,

5. To the fullest extent allowed by law, I agree to WAIVE, DISCHARGE ALL CLAIMS, AND HEREBY RELEASE FROM LIABILITY the NAS, its officers, moderators, agents, and leaders from any and all liability on account of, or in any way resulting from Injuries and Damages, even if caused by negligence of the NAS, its officers, moderators, agents, and leaders, in any way connected with this event. I further agree to INDEMNIFY the NAS, its moderators, agents, and leaders from all claims, damages, injuries, or losses caused by me while I am participating in this event. I understand and intend that this assumption of risk and release is binding upon my heirs, legatees, executors, administrators, successors, and assigns, and includes any minors participating with me in this event.

6. I understand and agree that this document covers this Nerf event in its entirety.

I HAVE READ THIS ACKNOWLEDGEMENT OF PARTICIPANT RESPONSIBILITY, EXPRESS ASSUMPTION OF RISK AND RELEASE OF LIABILITY, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
